VENGANZA Y DEFENSA LEGÍTIMA


La venganza consiste en la actuación ilícita que realiza una persona contra otra u otras como represalia o resarcimiento de una ofensa, ataque, delito, daño o mala acción recibidos y que, en vez de recurrir a la Justicia oficial (de denunciar el hecho ante la Policía o los Tribunales), decide devolver por sí misma un mal similar o mayor. 
Con frecuencia la venganza persigue reparar no sólo el perjuicio o injusticia sufridos y escarmentar al culpable/enemigo para que no reincida, sino también satisfacer el llamado sentimiento de "honor" (y/o de rencor) afectados; si  lo consigue, el vengador suele experimentar una malsana sensación de placer. 
Las acciones vengativas se dan con mayor frecuencia en sujetos afectados por determinadas alteraciones de la conducta, como en las psicopatías o bajo la influencia de estados emocionales negativos (odio, celos, envidia, codicia, racismo, fobias, etc); también son habituales entre delincuentes (ajustes de cuentas, sicarios)

Naturalmente, en las sociedades civilizadas, la venganza no oficial está prohibida y penalizada, y sólo se contempla una exención o atenuación de la responsabilidad criminal en los casos de defensa legítima, cuando concurren ciertos requisitos previstos en la ley 


En los tiempos históricos remotos e incluso en épocas recientes, la venganza ha sido un medio usual de hacer justicia contra las acciones agresivas, amenazantes u hostiles; especialmente en lugares donde no imperaba un gobierno o sistema administrativo que garantizase el cumplimiento de la ley: pensemos en los tiempos tribales de la prehistoria, en las poblaciones aisladas medievales o, más próximamente, en el salvaje Oeste americano o en los llamados "katakiuchi" de Japón (asesinatos vengativos realizados por Samurais) e incluso, actualmente, en ciertas situaciones anárquicas popias de revoluciones sociales, guerras. etc o en regiones donde campan a sus anchas las bandas criminales  ("vendettas" mafiosas)

Sin embargo, a pesar de la popularidad positiva que alcanzan en las novelas o las películas ciertos personajes "justicieros", la venganza suele estar muy lejos de la verdadera justicia y, con frecuencia produce mayores males que los que pretende remediar. 

LA LEY DEL TALIÓN 


Por ello, desde la antigüedad, los legisladores intentaron regular, "ajustar" y suavizar estos métodos vengativos, con ciertos preceptos que se recogieron primero en la denominada Ley del Talión ("ojo por ojo, diente por diente") y posteriormente también, a través de enfrentamientos o combates ritualizados  y arbitrados (con padrinos o testigos) como ocurría en las justas medievales o, a partir del siglo XVI, en los desafíos o los duelos.


La Ley del Talión ha estado presente en varios ordenamientos jurídicos de épocas pasadas: comenzando en el Código de Hammurabi (1700 años antes de nuestra Era), y continuando después en otras compilaciones normativas como la Ley Mosaica, la Ley de las XII Tablas, el Blurtage o "venganza de sangre" del Derecho germánico, etc.
Y todavía, en la actualidad, existen legislaciones que recogen preceptos típicos de la Ley del Talión.

 En el Código de Hammurabi, la Ley del Talión trataba de limitar los excesos de las sentencias vengativas y arbitrarias que solían imponerse y para ello establecía una cierta proporción entre el daño causado y la pena aplicable.

 Así, si alguien le sacaba un ojo o le cortaba una mano o una pierna a otro, al culpable se le  mutilaba de la misma forma; al ladrón se le cortaban las manos; y la lengua al que injuriaba o declaraba como testigo falso.
La pena de muerte era aplicada frecuentemente, no sólo por asesinar o matar a otro, sino también por bandidaje, ayuda a la fuga de un esclavo, etc

HACIA LA JUSTICIA UNIVERSAL Y LOS DERECHOS HUMANOS

Posteriormente, a lo largo de la historia, los preceptos de la Ley del Talión se fueron atenuando, introduciéndose la posibilidad del perdón de la víctima, el acuerdo entre las partes, etc, hasta evolucionar, en los últimos siglos, hacia un derecho más racionalizado e integrador que buscaba no sólo el castigo del delincuente, sino su arrepentimiento y rehabilitación. 

No obstante, determinadas penas o sanciones que aún se aplican en muchos países, como las condenas a muerte, mutilaciones, torturas, lapidación, trabajos forzados, etc, se consideran reminiscencias de la antigua Ley del Talión que, a juicio de numerosos juristas, deberían ser abolidas o sustituidas por otros tratamientos más humanitarios, educativos y reformadores, que se ajustaran mejor a las directrices de la Declaración Universal de los Derechos Humanos.

NECESIDAD DE UNA JUSTICIA IMPARCIAL, EQUILIBRADA, INDEPENDIENTE Y GLOBALIZADA

Para que las personas que habitamos el planeta Tierra, podamos vivir y convivir pacíficamente, amparadas por unas leyes basadas en los derechos humanos, es preciso que la institución llamada JUSTICIA sea capaz de ejercer, en todo momento y lugar, la facultad o el arte de "dar a cada uno lo suyo" con honradez, equidad e imparcialidad, aplicando un poder equilibrado, efectivo e independiente. 

Por eso, en la mitología griega y romana, la diosa de la Justicia era representada por una estatua de mujer con los ojos vendados y portando una balanza y una espada.

  
La JUSTICIA o PODER JUDICIAL, es uno de los tres poderes fundamentales del Estado que protagonizan los magistrados, jueces y jurados, con la colaboración de los cuerpos policiales, fiscales, abogados y otros órganos administrativos.

Para que sea aplicada con eficacia, la Justicia debe funcionar adecuadamente tanto a nivel nacional como a nivel internacional/global o universal, ya que los conflictos - especialmente los conflictos bélicos/guerras - entre países constituyen la principal causa de infracciones criminales graves  (muertes, mutilaciones, sufrimientos, violencia, desastres, etc) que aquejan a la humanidad.

EVOLUCIÓN HISTÓRICA DE LA JUSTICIA Y LOS DERECHOS DE LA PERSONA

En épocas prehistóricas lejanas, nuestros antepasados australophitecos y homínidos, desde muchos miles - o tal vez millones - de años, anteriores al amanecer evolutivo de los "Homos Sapiens Sapiens", convivían y se comportaban de forma muy parecida a como lo hacían y hacen otras especies animales para sobrevivir o resolver los conflictos: recolección, caza, depredación, canibalismo, luchas por la posesión de una cueva o el dominio sobre un territorio, uso de la fuerza y la violencia para afirmar el liderazgo de un clan o la consecución de las mejores hembras, etc.
Eran procedimientos instintivos basados en claves hereditarias transmitidas de una a otra generación desde nuestros lejanos ancestros mamíferos y reptiles... 
Los únicos indicios de "justicia" que se les podría suponer eran sus conductas de luchas, represalias o venganzas y también de ayuda mutua o de protección de la prole, similares a los de otras especies de aves y mamíferos.

En etapas más avanzadas, al incrementar su inteligencia, nuestros antepasados, ya más sapiens, se organizan en clanes o jerarquías "potitico-familiares" o "seudo-religiosos" y para conseguir la sumisión, unidad y obediencia de los demás miembros de la tribu, inventan  supersticiones, tabúes, "reglas" o normas, de obligado cumplimiento... que, con paso de los siglos, tras la invención de la escritura, acabarán plasmándose en las llamadas tablas, mandamientos, ordenanzas, códices, etc; así aparecen las primeras estructuras de lo que más tarde serán las instituciones de la justicia con sus leyes, derechos y obligaciones...

Las cambiantes estructuras jurídicas y normativas que se van sucediendo, desde los egipcios hasta los griegos, romanos y la época medieval  - ley del Talión, Código de Hammurabi, Ley Mosaica, Ley de las XII tablas, Código Carolingio, Las Partidas, etc 
- si bien avanzan lentamente hacia unos procedimientos judiciales cada vez más equilibrados, no llegan a conseguir el ideal de justicia integral y universal que si empieza a gestarse, ya en la edad moderna, con la Declaración de los Derechos del Hombre y del Ciudadano de 1789.

En los siglos siguientes, las nuevas constituciones nacionales irán consolidando y mejorando una trayectoria ideológica y jurídica hacia una justicia democrática favorable a los derechos de la persona. 
Dichos avances se concretarán finalmente en la Declaración de los Derechos Humanos aprobada por la Asamblea General de las Naciones Unidas en 1948. 


LAS INJUSTICIAS COMO FENÓMENO GENERALIZADO
Pero, a pesar de estos avances, nuestra desventurada especie ha padecido desde siempre, y sigue padeciendo ahora, numerosos episodios de terribles INJUSTICIAS, con millones de muertos, heridos y mutilados; de mujeres violadas; de secuestros, robos, asaltos, incendios, daños, extorsiones, amenazas, etc.., sucesos que han sufrido y siguen sufriendo especialmente las personas más pobres, débiles o desamparadas (niños, ancianos, mujeres, etc):
GUERRAS, HOMICIDIOS, MATANZAS, CAMPOS DE EXTERMINIO, MUTILACIONES, TORTURAS, ABUSOS SEXUALES, ENCARCELAMIENTOS INJUSTOS, REPRESIONES Y EMIGRACIONES FORZADAS, POBREZA, HAMBRE, EXPLOTACIÓN Y SERVIDUMBRES LABORABLES abusivas o esclavizantes, INSEGURIDAD, ACCIONES CRIMINALES repetidas, DESAMPARO, FALTA DE MEDIOS SANITARIOS, MATERIALES Y EDUCACIONALES (viviendas, escuelas, hospitales, medicamentos), FALTA DE LIBERTADES SOCIO-POLÍTICAS Y RELIGIOSAS, con frecuentes imposiciones IDEOLÓGICAS FANÁTICAS, RACISTAS o XENÓFOBAS; COSTUMBRES SOCIALES atentatorias para la vida, salud y libertad de las personas (como la ablación del clítoris o o la venta de niñas para ser casadas con hombres adultos), o determinados "JUICIOS POPULARES", sin ninguna garantía jurídica, en los que la plebe de algunos países condena a penas de muerte por lapidación o a mutilaciones a personas, generalmente mujeres, acusadas de adulterio, blasfemias,  etc....

Como muestra, cabe recordar los sucesos bélicos de los  últimos cien años:  más de 100 millones de víctimas entre muertos y mutilados, así como destrucciones masivas de pueblos y ciudades con pérdidas incalculables...(Primera y la Segunda Guerras Mundiales, Guerra Civil en España, etc)

Gran número de los CRÍMENES que se cometen en el Mundo suelen quedar IMPUNES debido a la falta de coordinación de las legislaciones e instituciones juridiscionales de los diferentes Estados, con tipificaciones penales distintas, sin tratados de extradición o convenios de colaboración judicial y policial efectivos y también, en muchos países, por falta de suficiente independencia de jueces y magistrados o por la inoperancia, corrupción o mala fé
 de ciertas estructuras gubernativas anti-democráticas.


ACUERDOS E INSTITUCIONES JURÍDICAS PARA CONSEGUIR UNA JUSTICIA MÁS EFECTIVA

Para tratar de poner remedio a estos problemas, la mayoría de los Estados modernos han firmado una serie de convenios 
o se han dotado de tribunales, instituciones y organismos internacionales como la DECLARACIÓN UNIVERSAL DE LOS DERECHOS HUMANOS, INTERPOL (Organización Internacional de Policía Criminal), la CORTE PENAL INTERNACIONAL, la CONVENCION SOBRE LOS DERECHOS DEL NIÑO o el CONSEJO DE DERECHOS HUMANOS DE LAS NACIONES UNIDAS.

 LLAMADA A LA ESPERANZA PARA ALCANZAR MAYORES COTAS DE PAZ, JUSTICIA Y PROGRESO EN TODOS LOS PAÍSES DEL MUNDO

Conseguir una justicia global que garantice el cumplimiento de la Declaración Universal de los Derechos humanos es un objetivo trascendental aunque su logro sea difícil en muchas regiones del Planeta.

Solo con una firme voluntad de diálogo y consecución de acuerdos para incrementar la paz y la justicia de todas las gentes y pueblos de la Tierra, y especialmente, de los líderes políticos, religiosos y económicos de los Estados y Organizaciones internacionales, podremos seguir avanzando en la terminación de las guerras y conflictos y en una mejor distribución de los recursos y riquezas que permitan mejores condiciones de vida y trabajo a los cientos de miles de personas que en la actualidad padecen hambre y pobreza en numerosas zonas del mundo.

Urge organizar pasillos de ayuda humanitaria a las zonas más afectadas por la pobreza y los conflictos bélicos, empleando a los ejércitos, en vez de en las guerras habituales, en otras tareas de pacificación/desarme y asistencia a las poblaciones necesitadas.

También es necesario aislar y acabar con los tiranos y dirigentes políticos explotadores, así como con todos los que cometen delitos de corrupción financiera y acaparamiento de riquezas en perjuicio de las poblaciones oprimidas
Para ello es imprescindible combatir y desarticular los paraísos fiscales que acaparan los ingentes riquezas desviadas por políticos y financieros corrompidos.

Y, finalmente, luchar contra las bandas terroristas, las organizaciones con ideologías fanáticas destructivas, y contra la delincuencia organizada, utilizando la cooperación internacional de los cuerpos policiales y estructuras jurídicas de todos los estados mediante la coordinación de Interpol y de la Corte Penal Internacional.

Creo que vale la pena este esfuerzo pacificador y justiciero, porque la paz y la justicia son siempre rentables no sólo como valores morales y para incrementar los niveles de seguridad mundial, evitando muertes y desgracias, sino también para conseguir mejoras económicas, empresariales, comerciales, turísticas, etc, que combatan la pobreza y proporcionen recursos y puestos de trabajo.


Está demostrado que los países que han evitado las guerras y han fomentado los gobiernos democráticos, combatiendo la criminalidad y la corrupción y acrecentando la sanidad y la educación. se han transformado en naciones  desarrolladas y prósperas que alcanzan actualmente los mejores niveles de calidad de vida.

It is also necessary to isolate and end the tyrants and exploitative political leaders, as well as all those who commit crimes of financial corruption and hoarding of wealth to the detriment of oppressed populations.
For this, it is essential to combat and dismantle the tax havens that hoard the enormous wealth diverted by corrupt politicians and financiers.

And, finally, fight against terrorist gangs, organizations with destructive fanatic ideologies, and against organized crime, using the international cooperation of the police forces and legal structures of all states through the coordination of Interpol and the International Criminal Court.

I believe that this peace and justice effort is worthwhile, because peace and justice are always profitable not only as moral values ​​and to increase the levels of world security, avoiding deaths and misfortunes, but also to achieve economic, business and commercial improvements, tourism, etc., that fight poverty and provide resources and jobs.

It is proven that the countries that have avoided wars and promoted democratic governments, fighting crime and corruption and increasing health and education. they have become developed and prosperous nations that currently achieve the best levels of quality of life.

DECLARACIÓN UNIVERSAL DE LOS DERECHOS HUMANOS

Art 1 - Todos los seres humanos nacen libres e iguales en dignidad y derechos y, dotados como están de razón y conciencia, deben comportarse fraternalmente los unos con los otros.

Ar 2 - 1. Toda persona tiene los derechos y libertades proclamados en esta Declaración, sin distinción alguna de raza, color, sexo, idioma, religión, opinión política o de cualquier otra índole, origen nacional o social, posición económica, nacimiento o cualquier otra condición.
2. Además, no se hará distinción alguna fundada en la condición política, jurídica o internacional del país o territorio de cuya jurisdicción dependa una persona, tanto si se trata de un país independiente, como de un territorio bajo administración fiduciaria, no autónomo o sometido a cualquier otra limitación de soberanía.

Art 3 - Todo individuo tiene derecho a la vida, a la libertad y a la seguridad de su  persona.

Art 4 - Nadie estará sometido a esclavitud ni a servidumbre; la esclavitud y la trata de esclavos están prohibidas en todas sus formas.

Art 5 - Nadie será sometido a torturas ni a penas o tratos crueles, inhumanos o degradantes.

Art 6 - Todo ser humano tiene derecho, en todas partes, al reconocimiento de su personalidad jurídica.

Art 7 - Todos son iguales ante la ley y tienen, sin distinción, derecho a igual protección de la ley. Todos tienen derecho a igual protección contra toda discriminación que infrinja esta Declaración y contra toda provocación a tal  discriminación.

Art 8 - Toda persona tiene derecho a un recurso efectivo, ante los tribunales  nacionales competentes, que la ampare contra actos que violen sus derechos  fundamentales reconocidos por la constitución o por la ley.

Art 9 - Nadie podrá ser arbitrariamente detenido, preso ni desterrado.

Art 10 - Toda persona tiene derecho, en condiciones de plena igualdad, a ser oída  públicamente y con justicia por un tribunal independiente e imparcial, para  la determinación de sus derechos y obligaciones o para el examen de cualquier acusación contra ella en materia penal.

Art 11 - 1. Toda persona acusada de delito tiene derecho a que se presuma su inocencia mientras no se pruebe su culpabilidad, conforme a la ley y en juicio público en el que se le hayan asegurado todas las garantías necesarias para su defensa.
2. Nadie será condenado por actos u omisiones que en el momento de cometerse no fueron delictivos según el Derecho nacional o internacional. Tampoco se impondrá pena más grave que la aplicable en el momento de la comisión del delito.

Art 12 - Nadie será objeto de injerencias arbitrarias en su vida privada, su familia su domicilio o su correspondencia, ni de ataques a su honra o a su reputación. Toda persona tiene derecho a la protección de la ley contra tales injerencias o ataques.

Art 13 - 1. Toda persona tiene derecho a circular libremente y a elegir su residencia  en el territorio de un Estado.
 2. Toda persona tiene derecho a salir de cualquier país, incluso el propio,  y a regresar a su país.

Art 14 - 1. En caso de persecución, toda persona tiene derecho a buscar asilo, y a disfrutar de él, en cualquier país.
 2. Este derecho no podrá ser invocado contra una acción judicial realmente  originada por delitos comunes o por actos opuestos a los propósitos y principios de las Naciones Unidas.

Art 15 - 1. Toda persona tiene derecho a una nacionalidad.
 2. A nadie se privará arbitrariamente de su nacionalidad ni del derecho a cambiar de nacionalidad.

Art 16 - 1. Los hombres y las mujeres, a partir de la edad núbil, tienen derecho, sin restricción alguna por motivos de raza, nacionalidad o religión, a casarse y fundar una familia; y disfrutarán de iguales derechos en cuanto al matrimonio, durante el matrimonio y en caso de disolución del matrimonio.
2. Sólo mediante libre y pleno consentimiento de los futuros esposos podrá contraerse el matrimonio.
3. La familia es el elemento natural y fundamental de la sociedad y tiene derecho a la protección de la sociedad y del Estado.

Art 17 - 1. Toda persona tiene derecho a la propiedad, individual y colectivamente.
 2. Nadie será privado arbitrariamente de su propiedad.

Art 18 - Toda persona tiene derecho a la libertad de pensamiento, de conciencia y de religión; este derecho incluye la libertad de cambiar de religión o de creencia, así como la libertad de manifestar su religión o su creencia, individual y colectivamente, tanto en público como en privado, por la enseñanza, la práctica, el culto y la observancia.

Art 19 - Todo individuo tiene derecho a la libertad de opinión y de expresión; este  derecho incluye el no ser molestado a causa de sus opiniones, el de  investigar y recibir informaciones y opiniones, y el de difundirlas, sin limitación de fronteras, por cualquier medio de expresión.

Art 20 - 1. Toda persona tiene derecho a la libertad de reunión y de asociación  pacíficas.
 2. Nadie podrá ser obligado a pertenecer a una asociación.

Art 21 - 1. Toda persona tiene derecho a participar en el gobierno de su país,  directamente o por medio de representantes libremente escogidos.
2. Toda persona tiene el derecho de acceso, en condiciones de igualdad, a las funciones públicas de su país.
3. La voluntad del pueblo es la base de la autoridad del poder público; esta voluntad se expresará mediante elecciones auténticas que habrán de celebrarse periódicamente, por sufragio universal e igual y por voto secreto   u otro procedimiento equivalente que garantice la libertad del voto.

Art 22 - Toda persona, como miembro de la sociedad, tiene derecho a la seguridad social, y a obtener, mediante el esfuerzo nacional y la cooperación  internacional, habida cuenta de la organización y los recursos de cada Estado, la satisfacción de los derechos económicos, sociales y culturales,  indispensables a su dignidad y al libre desarrollo de su personalidad.

Art 23 - 1. Toda persona tiene derecho al trabajo, a la libre elección de su trabajo, a condiciones equitativas y satisfactorias de trabajo y a la protección  contra el desempleo.
 2. Toda persona tiene derecho, sin discriminación alguna, a igual salario por  trabajo igual.
 3. Toda persona que trabaja tiene derecho a una remuneración equitativa y satisfactoria, que le asegure, así como a su familia, una existencia conforme a la dignidad humana y que será completada, en caso necesario, por  cualesquiera otros medios de protección social.
 4. Toda persona tiene derecho a fundar sindicatos y a sindicarse para la defensa de sus intereses.

Art 24 - Toda persona tiene derecho al descanso, al disfrute del tiempo libre, a una limitación razonable de la duración del trabajo y a vacaciones periódicas pagadas.

Art 25 - 1. Toda persona tiene derecho a un nivel de vida adecuado que le asegure,  así como a su familia, la salud y el bienestar, y en especial la alimentación, el vestido, la vivienda, la asistencia médica y los servicios sociales necesarios; tiene asimismo derecho a los seguros en caso de desempleo, enfermedad, invalidez, viudez, vejez y otros casos de pérdida de sus medios de subsistencia por circunstancias independientes de su voluntad.
 2. La maternidad y la infancia tienen derecho a cuidados y asistencia especiales. Todos los niños, nacidos de matrimonio o fuera de matrimonio, tienen derecho a igual protección social.

Art 26 - 1. Toda persona tiene derecho a la educación. La educación debe ser gratuita, al menos en lo concerniente a la instrucción elemental y fundamental. La instrucción elemental será obligatoria. La instrucción técnica y profesional habrá de ser generalizada; el acceso a los estudios superiores será igual para todos, en función de los méritos respectivos.
 2. La educación tendrá por objeto el pleno desarrollo de la personalidad humana y el fortalecimiento del respeto a los derechos humanos y a las libertades fundamentales; favorecerá la comprensión, la tolerancia y laamistad entre todas las naciones y todos los grupos étnicos o religiosos; y promoverá el desarrollo de las actividades de las Naciones Unidas para el  mantenimiento de la paz.
 3. Los padres tendrán derecho preferente a escoger el tipo de educación que habrá de darse a sus hijos.

Art 27 - 1. Toda persona tiene derecho a tomar parte libremente en la vida cultural de la comunidad, a gozar de las artes y a participar en el progreso científico y en los beneficios que de él resulten.
2. Toda persona tiene derecho a la protección de los intereses morales y materiales que le correspondan por razón de las producciones científicas, literarias o artísticas de que sea autora.

Art 28 - Toda persona tiene derecho a que se establezca un orden social e internacional en el que los derechos y libertades proclamados en esta Declaración se hagan plenamente efectivos.

Art 29 - 1. Toda persona tiene deberes respecto a la comunidad, puesto que sólo en ella puede desarrollar libre y plenamente su personalidad.
2. En el ejercicio de sus derechos y en el disfrute de sus libertades, toda persona estará solamente sujeta a las limitaciones establecidas por la ley con el único fin de asegurar el reconocimiento y el respeto de los derechos y libertades de los demás, y de satisfacer las justas exigencias de la moral, del orden público y del bienestar general en una sociedad democrática.
3. Estos derechos y libertades no podrán en ningún caso ser ejercidos en oposición a los propósitos y principios de las Naciones Unidas.

Art 30 - Nada en la presente Declaración podrá interpretarse en el sentido de que  confiere derecho alguno al Estado, a un grupo o a una persona, para emprender y desarrollar actividades o realizar actos tendientes a la supresión de cualquiera de los derechos y libertades proclamados en esta Declaración.

Art 1 - All human beings are born free and equal in dignity and rights and, endowed as they are with reason and conscience, they must behave fraternally with one another.

Ar 2 - 1. Everyone has the rights and freedoms proclaimed in this Declaration, without any distinction of race, color, sex, language, religion, political opinion or of any other nature, national or social origin, economic position, birth or any other other condition.
2. In addition, no distinction will be made based on the political, legal or international status of the country or territory on whose jurisdiction a person depends, whether it is an independent country, or a territory under fiduciary administration, not autonomous or subject to to any other limitation of sovereignty.

Art 3 - Every individual has the right to life, liberty and security of his person.

Art 4 - No one shall be subjected to slavery or servitude; slavery and the slave trade are prohibited in all their forms.

Art 5 - No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Art 6 - Every human being has the right, everywhere, to the recognition of his legal personality.

Art 7 - All are equal before the law and have, without distinction, the right to equal protection of the law. Everyone is entitled to equal protection against any discrimination that violates this Declaration and against any provocation to such discrimination.

Art 8 - Every person has the right to an effective remedy, before the competent national courts, that protects them against acts that violate their fundamental rights recognized by the constitution or by law.

Art 9 - No one may be arbitrarily detained, imprisoned or exiled.

Art 10 - Every person has the right, under conditions of full equality, to be heard publicly and fairly by an independent and impartial court, for the determination of their rights and obligations or for the examination of any accusation against them in criminal matters.

Art 11 - 1. Every person accused of a crime has the right to be presumed innocent as long as his guilt is not proven, in accordance with the law and in a public trial in which all the necessary guarantees for his defense have been assured.
2. No one shall be convicted of acts or omissions that at the time of their commission were not criminal according to national or international law. Nor shall a more serious penalty be imposed than that applicable at the time of the commission of the crime.

Art 24 - Everyone has the right to rest, to enjoy free time, to a reasonable limitation of the duration of work and to periodic paid vacations.

Art 25 - 1. Everyone has the right to an adequate standard of living that assures him, as well as his family, health and well-being, and especially food, clothing, housing, medical assistance and social services necessary; You are also entitled to insurance in case of unemployment, illness, disability, widowhood, old age and other cases of loss of your means of subsistence due to circumstances independent of your will.

Art 27 - 1. Everyone has the right to freely take part in the cultural life of the community, to enjoy the arts and to participate in scientific progress and the benefits that result from it.
2. Every person has the right to the protection of the moral and material interests that correspond to him by reason of the scientific, literary or artistic productions of which he is the author.

Art 28 - Everyone has the right to establish a social and international order in which the rights and freedoms proclaimed in this Declaration are fully effective.

Art 29 - 1. Everyone has duties towards the community, since only in it can they freely and fully develop their personality.
2. In the exercise of their rights and in the enjoyment of their freedoms, every person shall only be subject to the limitations established by law for the sole purpose of ensuring the recognition and respect of the rights and freedoms of others, and of satisfy the just demands of morality, public order and the general welfare in a democratic society.
3. These rights and freedoms may in no case be exercised in opposition to the purposes and principles of the United Nations.

Art 30 - Nothing in this Declaration may be interpreted in the sense that it confers any right to the State, to a group or to a person, to undertake and develop activities or carry out acts aimed at the suppression of any of the rights and freedoms proclaimed in this Statement.
